The Bail Bond Process
Posting a bail bond is like an agreement between the signer and a bail bondsman. The defendant or cosigner is contractually agreeing to pay 10% of the original bail in order to be released from jail. In addition the defendant is also agreeing to show up to all scheduled court dates.
In most cases a form of collateral, something of value from the defendant or cosigner, must be provided for the bail bondsman. This will be used to pay the court if the defendant fails to show arrive but will be returned after all court dates have been met. Some different forms of collateral are; personal property, real-estate, a pre-authorized credit account, or sometimes a signature with standing ties in the community.
Once a payment has been made and all of the paperwork has been taken care of a bondsman will post the bail immediately. From there it can take anywhere from 3 to 48 hours for the defendant to be released from custody. The time for release varies based on a number of factors such as; where the defendant is incarcerated, how busy the court or jail is, and how well staffed the court or jail is.
